Andy Cooley wins second defense verdict in as many months

KBM’s Andy Cooley obtained his second defense verdict in as many months in an employment discrimination trial. Andy defended the City of Bellevue Police Department and a lieutenant accused of retaliating against the plaintiff for making a charge of sexual harassment in the workplace. The plaintiff was allowed to proceed on a relatively novel theory of “hostile work environment retaliation.” The two theories are generally tried as separate causes of action, but the plaintiff believe the City and the lieutenant retaliated against her by creating a hostile work environment. The jury rejected all of the plaintiff’s factual claims and found in the City and the lieutenant’s favor on all counts.
